Privacy Notice
1. About us
Berry Consulting Limited (“we”, “us”) is registered in Jersey as a limited company under number 142103 and our registered office is at 17 Sandbanks, La Grande Route de la Cote, St Clement, JE2 6NE.
We are bound by data protection legislation in Jersey and are committed to protecting and respecting your privacy. This Privacy Notice (“Notice”) sets out the basis on which the personal data collected from you, or that you provide will be processed by us.
For the purpose of the Data Protection Legislation and this Notice, we are the ‘data controller’. This means that we are responsible for deciding how we hold and use personal data about you. We are required under the Data Protection Legislation to notify you of the information contained in this privacy notice.
2. The type of information we hold
We currently collect and process the following information:
- Personal details (e.g. name / email address / address)
- Information relating to contact we have had regarding provision of consultancy services (or
potential provision of services) - Details of any services you have received from us;
- Any correspondence that we have had with you;
- Information obtained through research or business development
- If you are a client, verification of identity documents as part of our client onboarding process
3. HOW WE GET THE INFORMATION AND WHY WE HAVE IT
Information is collected directly from you when you contact us via the website or otherwise when you engage us to provide services and during any engagements.
Information is collected indirectly from third parties or from the public domain (i.e. websites / linked in page).
Under the Data Protection (Jersey) Law 2018, the lawful basis we rely on for processing this information are:
Your consent.
You are able to remove your consent at any time. You can do this by contacting info@berryconsulting.je.
Or where we have a legitimate interest, provided that those interests do not override any of your own interests, rights and freedoms which require the protection of personal data. This includes processing for marketing, business development, statistical and management purposes.
4. WHAT WE DO WITH THE INFORMATION WE HAVE
We use the information that you have given us in order to complete our onboarding process, fulfil any obligations arising from engagement agreements, provide you with information regarding the services we provide, for professional networking and to request feedback.
In some circumstances we may sanitise personal data so that it can no longer be associated with you, in which case we may use it without further notice to you.
5. HOW WE STORE YOUR INFORMATION
Data retention
We will only retain your personal data for as long as is necessary to fulfil the purposes for which it is collected.
When assessing what retention period is appropriate for your personal data, we take into consideration the requirements of our business and the services provided, any statutory or legal obligations, and the purposes for which we originally collected the personal data.
Change of purpose
Where we need to use your personal data for a reason, other than the purpose for which we originally collected it, we will only use your personal data where that reason is compatible with the original purpose. If we need to use your data for a new purpose we will notify you and communicate our legal basis for this new processing.
6. YOUR DATA PROTECTION RIGHTS
In certain circumstances, under data protection law, you have rights including:
Your right of access – You have the right to ask us for copies of your personal information.
Your right to rectification – You have the right to ask us to rectify information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
Your right to erasure – You have the right to ask us to erase your personal information in certain circumstances.
Your right to restriction of processing – You have the right to ask us to restrict the processing of your information in certain circumstances.
Your right to object to processing – You have the right to object to the processing of your personal data in certain circumstances.
Your right to data portability – You have the right to ask that we transfer the information you gave us to another organisation, or to you, in certain circumstances.
You are not required to pay any charge for exercising your rights. If you make a request, we have four weeks to respond to you. Please contact us at info@berryconsulting.je if you wish to make a request.
7. HOW TO COMPLAIN
You also have the right to make a complaint to the Jersey Office of Information Commissioner, the Jersey supervisory authority for data protection issues, at any time.
